Ren\u00e9 Petr\u00e1\u0161e d\u011blit pr\u00e1vn\u00ed \u00fapravu cestovn\u00edho ruchu v\u00a0z\u00e1sad\u011b na t\u0159i, \u010di \u010dty\u0159i \u010d\u00e1sti. Jde tedy ov\u0161em o zna\u010dn\u00e9 zjednodu\u0161en\u00ed, kter\u00e9 m\u00e1 slou\u017eit zejm\u00e9na pot\u0159eb\u00e1m v\u00fduky.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: verdana,geneva,sans-serif;\"><strong>Prvn\u00ed tvo\u0159\u00ed speci\u00e1ln\u00ed p\u0159edpisy v\u00a0z\u00e1sad\u011b soukrom\u00e9ho (obchodn\u00edho a ob\u010dansk\u00e9ho) pr\u00e1va k\u00a0cestovn\u00edmu ruchu, co\u017e je j\u00e1dro \u010desk\u00e9 pr\u00e1vn\u00ed \u00fapravy<\/strong> cestovn\u00edho ruchu obsa\u017een\u00e9 hlavn\u011b ve speci\u00e1ln\u00edm z\u00e1kon\u011b \u010d. 159\/1999 Sb., o n\u011bkter\u00fdch podm\u00ednk\u00e1ch podnik\u00e1n\u00ed v oblasti cestovn\u00edho ruchu. Z\u00e1kon \u010d. 159\/1999 Sb. p\u0159inesl i novelizaci \u017eivnostensk\u00e9ho z\u00e1kona a p\u0159edev\u0161\u00edm ob\u010dansk\u00e9ho z\u00e1kon\u00edku \u010d. 40\/1964 Sb., kam za\u0159adil zcela nov\u00fd a v mnoh\u00e9m specifick\u00fd smluvn\u00ed typ cestovn\u00ed smlouvu, kterou v nov\u00e9m ob\u010dansk\u00e9m z\u00e1kon\u00edku nahradila smlouva o z\u00e1jezdu. Z\u00e1kon \u010d. 159\/1999 Sb. a \u017eivnostensk\u00fd z\u00e1kon tedy upravily hlavn\u011b \u010dinnost kl\u00ed\u010dov\u00fdch cestovn\u00edch kancel\u00e1\u0159\u00ed, ale pr\u00e1va z\u00e1kazn\u00edka obsahovala p\u0159edev\u0161\u00edm cestovn\u00ed smlouva (od 1.1. 2014 smlouva o z\u00e1jezdu) v ob\u010dansk\u00e9m z\u00e1kon\u00edku, p\u0159itom \u00faprava vych\u00e1zela z evropsk\u00e9ho pr\u00e1va a to hlavn\u011b sm\u011brnice \u010d. 90\/314\/EHS (nahrazena sm\u011brnic\u00ed 2015\/2302).\u00a0<\/span><span style=\"font-family: verdana,geneva,sans-serif;\">K smlouv\u011b o z\u00e1jezdu (d\u0159\u00edve cestovn\u00ed smlouv\u011b) a z\u00e1konu \u010d. 159\/1999 Sb., vych\u00e1zej\u00edc\u00edm p\u0159ev\u00e1\u017en\u011b z evropsk\u00e9 sm\u011brnice \u010d. 90\/314\/EHS, lze p\u0159idat i sv\u00e9r\u00e1znou problematiku timeshare. Jde nej\u010dast\u011bji o jak\u00fdsi dlouhodob\u00fd pron\u00e1jem zejm\u00e9na nemovitost\u00ed ur\u010den\u00fdch k rekrea\u010dn\u00edmu ubytov\u00e1n\u00ed. Tato problematika rovn\u011b\u017e vych\u00e1z\u00ed z evropsk\u00fdch sm\u011brnic z let 1994 a 2008. Vcelku jde tedy o ochranu spot\u0159ebitele v turismu.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: verdana,geneva,sans-serif;\">V pr\u00e1vn\u00ed \u00faprav\u011b cestovn\u00edho ruchu byla kl\u00ed\u010dov\u00fdm miln\u00edkem sm\u011brnice z 13. \u010dervna 1990 \u010d. 90\/314\/EHS. Vzorem pro toto \u0159e\u0161en\u00ed byla pr\u00e1vn\u00ed \u00faprava n\u011bmeck\u00e1, kde hlavn\u00ed byla novelizace ob\u010dansk\u00e9ho z\u00e1kon\u00edku (BGB z roku 1896), do n\u011bho\u017e byla za\u010dlen\u011bna v roce 1979 cestovn\u00ed smlouva (Reisevertrag \u00a7651a-\u00a7651m). Pr\u00e1vn\u00ed ochrana z\u00e1kazn\u00edk\u016f cestovn\u00edch kancel\u00e1\u0159\u00ed je toti\u017e pou\u017eiteln\u00e1 jen pro hromadn\u011b organizovanou turistiku, zat\u00edmco dlouho p\u0159evl\u00e1daly individu\u00e1ln\u00ed cesty, kter\u00e9 si zorganizoval samotn\u00fd turista. P\u0159\u00edstupy k implementaci sm\u011brnice \u010d. 90\/314\/EHS nov\u011b 2015\/2302, t\u00fdkaj\u00edc\u00ed se pr\u00e1vn\u011b pom\u011brn\u011b komplikovan\u00e9 ot\u00e1zky, jsou v EU zna\u010dn\u011b r\u016fznorod\u00e9. V \u0159ad\u011b zem\u00ed v\u010detn\u011b \u010cR byla pr\u00e1vn\u00ed \u00faprava, v t\u00e9 \u010di on\u00e9 m\u00ed\u0159e, za\u010dlen\u011bna do ob\u010dansk\u00fdch z\u00e1kon\u00edk\u016f (vlastn\u011b podle n\u011bmeck\u00e9ho vzoru) jako v Nizozem\u00ed \u010di na Slovensku (p\u016fvodn\u011b se zjevnou, \u010dasto doslovnou, n\u00e1vaznost\u00ed na \u010desk\u00fd z\u00e1kon \u010d. 159\/1999 Sb.), v Rakousku do z\u00e1kona na ochranu spot\u0159ebitele. V Polsku, Brit\u00e1nii, \u0160v\u00e9dsku, Belgii, D\u00e1nsku, Francii byla ot\u00e1zka \u0159e\u0161ena ve zvl\u00e1\u0161tn\u00edch z\u00e1konech.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: verdana,geneva,sans-serif;\"><strong>Za druhou \u010d\u00e1st pr\u00e1vn\u00ed \u00fapravy cestovn\u00edho ruchu lze snad pova\u017eovat obecn\u00e9 p\u0159edpisy obchodn\u00edho pr\u00e1va.<\/strong> Je nepochybn\u011b sporn\u00e9, zda tuto druhou skupinu pr\u00e1vn\u00ed \u00fapravy cestovn\u00edho ruchu v\u016fbec po\u010d\u00edtat \u2013 proto se zde hovo\u0159\u00ed o t\u0159ech \u010di \u010dty\u0159ech skupin\u00e1ch \u2013 proto\u017ee a\u017e na v\u00fdjimky nejde o speci\u00e1ln\u00ed normy t\u00fdkaj\u00edc\u00ed se cestovn\u00edho ruchu, ale obecn\u00e9 pr\u00e1vn\u00ed \u0159e\u0161en\u00ed podnik\u00e1n\u00ed. Jako speci\u00e1ln\u00ed \u010d\u00e1st pr\u00e1vn\u00ed \u00fapravy cestovn\u00edho ruchu je uv\u00e1d\u011bna zejm\u00e9na z\u00a0toho d\u016fvodu, \u017ee toto odv\u011btv\u00ed je n\u011bkdy ch\u00e1p\u00e1no jako z\u00e1kladn\u00ed z\u00a0hlediska cestovn\u00edho ruchu. Na \u0159ad\u011b \u0161kol se specializac\u00ed cestovn\u00ed ruch se tedy studenti sezn\u00e1m\u00ed jedin\u011b s\u00a0obecn\u00fdm obchodn\u00edm pr\u00e1vem na z\u00e1klad\u011b b\u011b\u017en\u00fdch u\u010debnic, kde b\u011b\u017en\u011b neb\u00fdv\u00e1 o cestovn\u00edm ruchu nic, a speci\u00e1ln\u00ed p\u0159edpisy b\u00fdvaj\u00ed jen okrajov\u011b zm\u00edn\u011bny.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: verdana,geneva,sans-serif;\">D\u016fle\u017eit\u00fdm z\u00e1konem, kter\u00fd p\u0159es sv\u016fj v z\u00e1sad\u011b ve\u0159ejnopr\u00e1vn\u00ed administrativn\u00ed charakter b\u00fdv\u00e1 \u0159azen k obchodn\u00edmu pr\u00e1vu, je \u017eivnostensk\u00fd z\u00e1kon \u010d. 455\/1991 Sb. Zde samoz\u0159ejm\u011b najdeme d\u016fle\u017eit\u00e1 ustanoven\u00ed t\u00fdkaj\u00edc\u00ed se podnik\u00e1n\u00ed v oboru cestovn\u00edho ruchu, tedy z\u00e1kladn\u00ed vymezen\u00ed cestovn\u00ed kancel\u00e1\u0159e, cestovn\u00ed agentury, ale i dal\u0161\u00edch \u017eivnost\u00ed. Za\u0159azen\u00ed jednotliv\u00fdch \u017eivnost\u00ed v oboru cestovn\u00edho ruchu je nestabiln\u00ed, a nutno dodat i nem\u00e1lo problematick\u00e9. V \u017eivnostensk\u00e9m z\u00e1kon\u011b je nyn\u00ed cestovn\u00ed kancel\u00e1\u0159 vymezena nepochybn\u011b spr\u00e1vn\u011b jako koncesovan\u00e1 \u017eivnost, cestovn\u00ed agentura a pr\u016fvodce v cestovn\u00edm ruchu v\u0161ak\u00a0 jako \u017eivnost voln\u00e1, zat\u00edmco d\u0159\u00edve byly po\u017eadavky na jejich provozov\u00e1n\u00ed vy\u0161\u0161\u00ed.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: verdana,geneva,sans-serif;\"><strong>K t\u0159et\u00ed \u010d\u00e1sti pr\u00e1vn\u00ed \u00fapravy cestovn\u00edho ruchu lze p\u0159i\u0159adit zejm\u00e9na ji\u017e v z\u00e1sad\u011b sto let p\u0159ipravovan\u00fd z\u00e1kon o podpo\u0159e rozvoje cestovn\u00edho ruchu, kter\u00fd spad\u00e1 z\u0159ejm\u011b do pr\u00e1va spr\u00e1vn\u00edho. U t\u0159et\u00ed a \u010dtvrt\u00e9 \u010d\u00e1sti pr\u00e1vn\u00ed \u00fapravy cestovn\u00edho ruchu, jak jsou zde vymezeny, jde o ve\u0159ejn\u00e9 pr\u00e1vo \u2013 p\u0159ev\u00e1\u017en\u011b spr\u00e1vn\u00ed pr\u00e1vo, zat\u00edmco prvn\u00ed dv\u011b \u010d\u00e1sti zahrnuj\u00ed soukrom\u00e9 pr\u00e1vo.<\/strong> Zm\u00ednit je t\u0159eba i \u00fapravu dan\u00ed, kde jsou i speci\u00e1ln\u00ed normy t\u00fdkaj\u00edc\u00ed se cestovn\u00edho ruchu, tak\u017ee sem okrajov\u011b spad\u00e1 i pr\u00e1vo finan\u010dn\u00ed. Jde hlavn\u011b o z\u00e1kon \u010d. 565\/1990 Sb., o m\u00edstn\u00edch poplatc\u00edch. Na rozd\u00edl od prvn\u00edch dvou skupin, tedy p\u0159edpis\u016f spadaj\u00edc\u00edch v z\u00e1sad\u011b do obchodn\u00edho a ob\u010dansk\u00e9ho pr\u00e1va a t\u00fdkaj\u00edc\u00edch se cestovn\u00edho ruchu, kter\u00e9 jsou z\u00e1sadn\u011b ovlivn\u011bny evropsk\u00fdm pr\u00e1vem, je zde tento vliv EU mnohem slab\u0161\u00ed. Jen\u017ee tato specifika pr\u00e1vn\u00ed \u00fapravy cestovn\u00edho ruchu \u2013 tedy hlavn\u011b dlouho p\u0159ipravovan\u00e9ho z\u00e1kona o podpo\u0159e cestovn\u00edho ruchu &#8211; jsou samoz\u0159ejm\u011b propojena s fungov\u00e1n\u00edm ve\u0159ejn\u00e9 spr\u00e1vy a syst\u00e9mem dan\u00ed v \u010cR. Mo\u017enosti zm\u011bn jsou tedy s t\u00edmto komplikovan\u00fdm syst\u00e9mem prov\u00e1z\u00e1ny a p\u0159itom bohu\u017eel \u010desk\u00e1 ve\u0159ejn\u00e1 spr\u00e1va m\u00e1 \u0159adu z\u00e1sadn\u00edch nedostatk\u016f. Od roku 2018 je neexistence z\u00e1kona \u0159e\u0161ena quasipr\u00e1vn\u00edm syst\u00e9mem certifikace destina\u010dn\u00edho managementu.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: verdana,geneva,sans-serif;\">Roky p\u0159ipravovan\u00fd zcela nov\u00fd z\u00e1kon o podpo\u0159e cestovn\u00edho ruchu by p\u0159edstavoval alespo\u0148 v \u010cR v podstat\u011b nov\u00fd fenom\u00e9n. N\u00e1vrh v\u011bcn\u00e9ho z\u00e1m\u011bru z\u00e1kona o podpo\u0159e a \u0159\u00edzen\u00ed cestovn\u00edho ruchu p\u0159ipravilo ministerstvo pro m\u00edstn\u00ed rozvoj v \u0159\u00edjnu 2011, v dal\u0161\u00edch jedn\u00e1n\u00edch byl n\u00e1vrh p\u0159ejmenov\u00e1n na z\u00e1kon o podpo\u0159e rozvoje cestovn\u00edho ruchu. Inspirac\u00ed je pr\u00e1vn\u00ed \u00faprava slovensk\u00e1, rakousk\u00e1, z\u010d\u00e1sti i \u0161v\u00fdcarsk\u00e1. Na Slovensku byl v b\u0159eznu 2010 p\u0159ijat takto pojat\u00fd z\u00e1kon \u010d. 91\/2010 Z.z., o podpore cestovn\u00e9ho ruchu, ale jeho aplikace v praxi m\u00e1 mnoh\u00e9 nedostatky.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: verdana,geneva,sans-serif;\"><strong>Jako \u010dtvrt\u00e1, posledn\u00ed skupina jsou zde vymezeny pr\u00e1vn\u00ed p\u0159edpisy souvisej\u00edc\u00ed s\u00a0cestovn\u00edm ruchem. Jejich mno\u017estv\u00ed je velmi vysok\u00e9 a hlavn\u011b jde o pozoruhodn\u011b rozmanit\u00e9 probl\u00e9my<\/strong> jako je pam\u00e1tkov\u00e1 p\u00e9\u010de, ochrana p\u0159\u00edrody, doprava, ale i speci\u00e1ln\u011bj\u0161\u00ed ot\u00e1zky jako je \u00faprava vina\u0159stv\u00ed \u010di t\u0159eba cestovn\u00edch doklad\u016f. Tyto probl\u00e9my lze p\u0159i\u0159adit nej\u010dast\u011bji ke spr\u00e1vn\u00edmu pr\u00e1vu. N\u011bkter\u00e9 prvky vyvol\u00e1vaj\u00ed zna\u010dn\u00fd z\u00e1jem \u010desk\u00fdch pr\u00e1vn\u00edch odborn\u00edk\u016f jako hlavn\u011b specifick\u00e9 pr\u00e1vo \u017eivotn\u00edho prost\u0159ed\u00ed, i kdy\u017e pr\u00e1v\u011b aspekty souvisej\u00edc\u00ed s cestovn\u00edm ruchem jsou \u010dasto p\u0159ehl\u00ed\u017eeny. Zvl\u00e1\u0161\u0165 komplikovan\u00e1 je pr\u00e1vn\u00ed \u00faprava dopravy, v \u010de\u0161tin\u011b v\u0161ak na rozd\u00edl zejm\u00e9na od n\u011bmecky mluv\u00edc\u00edch zem\u00ed dlouho nebyly zastoupeny odborn\u00e9 pr\u00e1ce, kter\u00e9 by ot\u00e1zku sledovaly z hlediska cestovn\u00edho ruchu. T\u0159eba o probl\u00e9mu cestovn\u00edch doklad\u016f v \u010desk\u00e9m pr\u00e1vu se najde n\u011bjak\u00fd pr\u00e1vn\u00ed p\u0159ehled jen obt\u00ed\u017en\u011b. Mnoh\u00e9 ot\u00e1zky p\u0159itom souvis\u00ed s cestovn\u00edm ruchem jen \u010d\u00e1ste\u010dn\u011b. Lze uv\u00e9st nap\u0159. l\u00e1ze\u0148stv\u00ed nebo vina\u0159stv\u00ed. Pr\u00e1v\u011b k t\u011bmto ot\u00e1zk\u00e1m pr\u00e1vn\u00edci publikovali v minul\u00fdch letech jen hrstku p\u0159\u00edsp\u011bvk\u016f. Tato d\u00edl\u010d\u00ed odv\u011btv\u00ed maj\u00ed p\u0159itom \u010dasto velmi specifick\u00e9 p\u0159\u00edstupy.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: verdana,geneva,sans-serif;\">Tento v\u00fd\u0161e uveden\u00fd syst\u00e9m je samoz\u0159ejm\u011b velk\u00fdm zjednodu\u0161en\u00edm, kter\u00fd m\u00e1 v\u0161ak v\u00fdrazn\u00fd p\u0159\u00ednos pro informaci nepr\u00e1vn\u00edk\u016f a jejich orientaci ve velmi komplikovan\u00e9 ot\u00e1zce. Krom\u011b zde uveden\u00fdch t\u0159\u00ed nebo \u010dty\u0159 skupin lze zm\u00ednit tak\u00e9 mezin\u00e1rodn\u00ed smlouvy. P\u0159\u00edmo se cestovn\u00edho ruchu t\u00fdkaj\u00ed mezin\u00e1rodn\u00ed smlouvy o spolupr\u00e1ci v oblasti turistiky, kter\u00e9 uzav\u0159ela \u010cR s mnoha st\u00e1ty. Jejich normativn\u00ed v\u00fdznam je ale velmi omezen\u00fd, kdy se zde obvykle nalezne sp\u00ed\u0161e jen proklamativn\u00ed z\u00e1vazek spolupr\u00e1ce, p\u0159\u00edpadn\u011b vytvo\u0159en\u00ed spole\u010dn\u00e9 komise.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: verdana,geneva,sans-serif;\">Pr\u00e1vn\u00ed \u00faprava cestovn\u00edho ruchu tedy <strong>nep\u0159edstavuje n\u011bjak\u00e9 tradi\u010dn\u00ed a relativn\u011b uzav\u0159en\u00e9 pr\u00e1vn\u00ed odv\u011btv\u00ed jako nap\u0159. trestn\u00ed, \u010di ob\u010dansk\u00e9 pr\u00e1vo<\/strong>, jejich\u017e z\u00e1klad nav\u00edc tvo\u0159\u00ed v\u00a0\u010cR a obvykle i dal\u0161\u00edch zem\u00edch kontinent\u00e1ln\u00ed pr\u00e1vn\u00ed kultury rozs\u00e1hl\u00fd z\u00e1kon\u00edk. Je to soubor r\u016fznorod\u00fdch p\u0159edpis\u016f spadaj\u00edc\u00edch do velmi odli\u0161n\u00fdch odv\u011btv\u00ed s\u00a0\u010dasto specifick\u00fdmi tradicemi, kter\u00e9 se t\u00fdkaj\u00ed cestovn\u00edho ruchu. <strong>Vymezen\u00ed, co v\u0161e p\u0159i\u0159adit k\u00a0problematice, i jak ji nazvat a definovat, se u jednotliv\u00fdch autor\u016f zna\u010dn\u011b li\u0161\u00ed.<\/strong> P\u0159itom mnoh\u00e9 prvky pr\u00e1vn\u00ed \u00fapravy jsou v\u00a0\u010cR i jin\u00fdch st\u00e1tech ost\u0159e diskutov\u00e1ny nebo jsou dokonce ter\u010dem ostr\u00e9 kritiky, kter\u00e1 neb\u00fdv\u00e1 v\u00a0pr\u00e1vn\u00ed v\u011bd\u011b zvykem. Ji\u017e samotn\u00e9 vymezen\u00ed t\u00e9to problematiky je i pro odborn\u00edka komplikovan\u00fd probl\u00e9m.
